											<p><img style="float:right; margin-right:5px;" src="http://images.cygnusinteractive.com/buttons/logo_lexis.gif" /></p>  <p>HASTINGS -- The wife of a Rutland Township man whose remains went unnoticed in a burned-out car after firefighters extinguished the blaze said she appreciates the apology she received from the Hastings Fire Department and other local officials.</p>    <p>"It's very nice that they finally came through with the apology," Marie Bailey said Thursday.</p> <p>The daughter of Paul Bailey Sr., 62, found her father's remains in the burned-out shell of his car last Friday, hours after firefighters had responded to douse the vehicle fire in Bailey's driveway.</p> <p>The seven volunteer firefighters who responded to the scene put out the fire, but told supervisors they never saw the man's remains inside and left a note for the car's owners, as no one was home at the time.</p> <p>Bailey's family members said the man's skull and bones were visible inside the vehicle.</p> <p>Marie Bailey said she did not know if her family would pursue a lawsuit over the incident. She declined further comment.</p> <p>Earlier this week, another family member called on the fire department to apologize.</p> <p>The apology issued Thursday, signed by Hastings Fire Chief Roger Caris, Mayor Robert May and other public officials, asked the family to accept "our most heartfelt condolences on your recent loss, and our deepest apologies for our failure to detect Mr. Bailey's remains following the recent fire.</p> <p>"We sincerely regret any emotional distress that this may have caused for you or anyone in your family, or for any of Mr. Bailey's friends or acquaintances," the letter states.</p> <p>"Please be aware that we are taking definitive steps to ensure to the fullest extent possible that this situation does not arise again in the future."</p> <p>Others who signed the letter include Assistant Fire Chief Rick Krouse, Hastings City Manager Jeffrey Mansfield, Rutland Township Supervisor Jim Carr and Jim Brown, chairman of the local townships' association that jointly operates the fire department with Hastings.</p> <p>The car fire appears accidental, police said.</p><p><HR /><div style="font:9px;"><p align="center"><a href="http://www.lexis-nexis.com/lncc/about/copyrt.html" target="_new">Copyright 2008 LexisNexis, a division of Reed Elsevier Inc. PATTON</strong><br /><em>Detroit Free Press</em></div>			<BR />			<div id="intelliTXT">													 <p xml:lang="en-US">     Detroit Police Chief Ella Bully-Cummings announced her retirement today through a news release just minutes after Mayor Kwame Kilpatrick pleaded guilty to two felonies and agreed to resign.</p> <p>     "As I move forward to the next chapter of my life, I look forward to spending time with my husband and my family, who have sacrificed so much the past five years," she told reporters today. "My desire was based upon my family's needs. I've delayed being with my family."</p> <p>     Bully-Cummings joined the department in 1977 at the age of 19. She left for several years to work as a lawyer and returned as assistant chief under then-Chief Jerry Oliver, replacing him on Nov. 3, 2003. Oliver left amid a scandal stemming from a gun being found in his luggage at Detroit Metropolitan Airport.</p> <p>     "The men and women of the Detroit Police Department would like to thank Chief Bully-Cummings for her years of dedicated service to the Department as well as her guidance and wish her well in all future endeavors," her spokesman James Tate said in a written statement.</p> <p>     Councilwoman Sheila Cockrel said she was pleased with Bully-Cummings' decision to retire.</p> <p>     "That's the department that needs a lot of attention," she said. "The chief's role in the Gary Brown firing fundamentally affected the chain of command."</p> <p>     Former Police Chief Isaiah "Ike" McKinnon, now an associate professor at the University of Detroit-Mercy, said he was sad to see her go but happy to see her spend time with her family.</p> <p>     McKinnon called Bully-Cummings, who served as his chief of staff for two years, a friend.</p> <p>     "When you are the first at something, you are really watched," he said. "She did an outstanding job responding to that."</p> <p>     Former Detroit Police Chief Benny Napoleon, who attended Cass Technical High School with Bully-Cummings, gave her tenure mixed reviews.</p> <p>     "Her legacy will be one of quite frankly discontent among the rank and file ... who are not very happy with the direction of the department," he said. He called her bright and capable, and said Bully-Cummings was handicapped with a reduced police force of 3,000 officers.</p> <p>     "She was placed at a severe disadvantage ... that you cannot blame her," he said.</p> <p>     Current Assistant Chief Ralph Godbee said the chief was a "tough businesswoman who had to make tough choices." 							PT>                            					<div class="deck11"><strong>JON BURSTEIN</strong><br /><em>Sun-Sentinel (Fort Lauderdale, Florida)</em></div>			<BR />			<div id="intelliTXT">													<p><img style="float:right; margin-right:5px;" src="http://images.cygnusinteractive.com/buttons/logo_lexis.gif" /></p>  <p>The Broward Sheriff's Office failed to follow its own policies in a botched 2004 raid that left Detective Todd Fatta dead, Sheriff Al Lamberti acknowledged Thursday as the agency reached a $2 million settlement with the late deputy's family.</p> <p>A special weapons unit, commonly known as a SWAT team, should have been used to execute the arrest warrant for Kenneth Wilk, a child porn suspect who was known to be armed and hate police, Lamberti said.</p>    <p>"We are here today to let everyone know that the right thing to do is take care of this so the family has closure ... and that we have healing in the Broward Sheriff's Office," Lamberti told a news conference.</p> <p>Wilk shot Fatta, 33, once in the chest with a Winchester rifle and wounded Sgt. Angelo Cedeño when sheriff's deputies raided his Fort Lauderdale home on Aug. 19, 2004.</p> <p>Jury selection in a wrongful death lawsuit filed by Fatta's family had been set to begin Monday. If the case had gone to trial, a parade of former and current Sheriff's Office personnel could have been called to the witness stand, including former Sheriff Ken Jenne, who was in charge when Fatta was killed.</p> <p>After Thursday's news conference, Fatta's mother, Josephine Fatta, embraced Lamberti. The family has said its lawsuit wasn't about money, but finding out the truth. "We miss our son very much," Josephine Fatta said. "It took four years for this to come to an end."</p> <p>Under Thursday's court-approved settlement, the Sheriff's Office agreed to pay $200,000 to Fatta's family - the maximum allowed under state law. The agency also will endorse a $1.8 million claims bill for the state Legislature's approval.</p> <p>Fatta's family had argued it was clear a SWAT team should have been used to arrest Wilk. Rank-and-file personnel were also afraid to question their superiors' decisions because Jenne's administration fostered a culture of fear and intimidation, the family's attorneys said.</p> <p>A team consisting entirely of SWAT members had been used at the same home a month earlier to search for child pornography. At that time, Wilk's partner, Kelly Ray Jones, was arrested.</p> <p>In addition, Sheriff's Office plans for both raids warned of guns in the home. Wilk had a gun on him during a previous search and a history of run-ins with law enforcement.</p> <p>A federal jury convicted Wilk last year of first-degree murder and he was sentenced to life in prison. Wilk is appealing. One of his arguments is that the judge improperly excluded evidence that the Sheriff's Office botched the raid.</p> <p>Lamberti said that while the agency failed to take every precaution possible, "Kenneth Wilk was obviously hell-bent on killing a deputy that day."</p> <p>The Fatta family's attorneys, who have been critical of Jenne's administration, commended Lamberti at Thursday's news conference.</p> <p>"You &#091;Lamberti&#093; are the first person to stand up and face the family and tell them the truth," said Andrew Yaffa, one of the lawyers.</p> <p>Jenne said in a sworn statement last month that Fatta wouldn't have been killed if the agency had obeyed its own policies and used the better-equipped SWAT members. Jenne made the admissions in a deposition he gave at a federal prison in Virginia, where he had been serving a sentence for mail fraud and conspiracy.</p> <p>Lamberti announced Thursday he has put together a committee to examine what went wrong with the raid. After Fatta's death, the Sheriff's Office revised its SWAT policy, calling for the team to execute any forced entries and to have paramedics on scene. As he searched the salon he fired several shots.<br /><br />As responding officers arrived at the scene, they exchanged shots with the man and Sergeant Starzyck was struck.                 <p>WASHINGTON (AP)&#8212;The first meeting between Washington, D.C., schools Georgetown
and Howard was postponed Saturday because of Tropical Storm Hanna. The game has
been rescheduled to Sunday.</p>
<p>Georgetown coach Kevin Kelly said the decision was made with the safety of
the athletes and fans in mind. Kelly said the weather was expected to improve
Sunday for what may become a great college rivalry for the nation&#8217;s capital.</p>
<p>The game will be played at Greene Stadium on Howard&#8217;s campus. The schools
agreed to a four-game series.</p>
